Pass a brief examination test that will require uploading a few of your best files;
After you have successfully passed your examination test, you'll be able to upload your files to the site for sale.
All of the files you upload will be checked by our inspectors, and once they pass inspection, they'll appear on the website. Starting from that moment, they are available to Buyers, and can start turning a profit!
1. Contributor Terms and Conditions:
1.1 By accepting the terms and conditions of that you sign while creating a common account, and uploading your files to our website, you warrant the following:
You are the author of all the files you upload;
You are 18 or older;
You possess all the required documents and rights allowing you to display and use your files as well as their related elements (model releases, property releases, etc.).
1.2 File Requirements:
Photo Requirements:
Photos must be in JPEG/JPG format with an RGB color space;
Minimum resolution is 3.8 MP (2400 x 1600 pixels);
Photos may not be larger than 5 megabytes.
Vector Image Requirements:
Supported vector image formats: AI and EPS;
Vector images must be in a ZIP archive with a JPEG/JPG preview. Minimum resolution of JPEG/JPG preview is 3.8 MP (2400 x 1600 pixels);
Each ZIP archive may not be larger than 50 megabytes.
Video Requirements:
We accept the following video formats: ASF, AVI, DV, FLV, MOV, MPEG/MPG, WMV;
We accept the following video codecs: Photo JPEG, Motion JPEG-A/B; DV, HDV, DVCPro; H.264/AVC, DivX, Xvid, SVQ1, MP42, MP43,MPG4, MP4V, M4S2, MPEG-1, MPEG-2; WMV2, WMV3; FLV;
The frames-per-second (FPS) should correspond to the video format (NTSC standard of 29.97 FPS or the PAL standard of 25 FPS). We accept 23.976, 24, 25, 29.97, 30, 50, 59.93 or 60 FPS
Minimum resolution is 0.07 MP (320 x 240 pixels). Maximum resolution is not limited;
Minimum video length is 3 seconds. Maximum video length is 60 seconds;
The compression level should correspond to the best possible image quality;
Sound can be accepted if it is part of the scene (ambient sounds, voices). Video must NOT contain any audio track not owned by the video contributor;
Maximum file size for video is 2048 MB.
1.3 Contributor's Level:
A Contributor's Level is determined by the number of a Contributor's files sold on our website. The more sales you have, the higher your Contributor's Level. Hence, the higher your Contributor's Level, the bigger your royalties.

Silver 50 - 499 downloads
Gold 500+ downloads
Note: Each file downloaded using On Demand Downloads counts as 1 download toward your Level. A file purchased via subscription plan counts as one-third download toward your Level; i.e., 3 files downloaded via subscription plan count as 1 download toward your Level.
Royalties for Files Purchased via On Demand Downloads:
Our Buyers can use On Demand Downloads to download photos, vector images, and videos uploaded by Contributors. If a file was purchased under a Standard License or Extended License , your royalty rate will depend solely upon your Contributor's Level, as follows:
Contributor's Level and Royalties for Each File Sold
Bronze 60%
Silver 70%
Gold 80%
Note: Royalty calculations are based not on a "standard" value of a file, but on the actual amount paid by a Buyer. If a Buyer gets a discount on the purchase, the royalties received by the Contributor for the file will be based on the amount paid by the Buyer, incorporating the discount and transfer fees, and not the “standard” value of the file.
In the event that YourMotorBikePhoto is obliged to pay any taxes to third parties for purchase of the File (for example, via an Apple In-App Purchase), the amount of royalties paid to the Contributor will be calculated from the actual amount YourMotorBikePhoto receives after paying all taxes.
Royalties for Files Purchased via Subscription:
With subscription plans, Buyers can download photos and vector images. If an image was purchased with any of our subscription plans, your royalty rate is fixed and depends upon your Contributor's Level:

Note: Videos cannot be purchased via subscription.
Note: If an image was purchased via a monthly subscription plan, your royalty rate will depend on your Contributor's Level. Royalty calculations are based on the price of the subscription plan and the number of downloads included in it. If a Buyer gets a discount on the purchase, the royalties received by the Contributor for the file will be based on the amount paid by the Buyer, incorporating the discount, and not the “standard” value of the file.
2. Affiliate Terms and Conditions
2.1 In order for a new user to be registered as a Referral, the following technical requirements must be met:
The Referral must arrive at the Website via a Referral link (regardless of whether the link is placed on a Website page, via e-mail, banner ad or other link, or copied into a browser line manually);
The new Referral registration must take place no later than 72 hours after the Referral’s original visit via the Referral link;
Cookies must be active on the new Referral’s computer (e.g., they must not be erased between the time the user arrives at the website and the time the user registers).
In the event that these technical requirements are met and the new Referral's lands and registers at the Site through the User’s link, the new Referral will be recorded in the YourMotorBikePhoto database as the User’s Referral and will be included in the Referral statistics for the purpose of tracking site use and computing remuneration.
2.2 REMUNERATION FOR USER ATTRACTION
A User of YourMotorBikephoto who attracts new Referrals will be remunerated as described:
If a buyer signs up then an affiliate gets 7% commission from all orders of the buyer.
If a seller signs up then an affiliate gets 5% commission from all sells of the seller.
2.3 REMUNERATION PAYMENT PROCEDURE
All Referral Program remunerations are added automatically to the User’s account and can be withdrawn according to the standard procedure, whenever the balance is $50 US or more.
2.4 FORBIDDEN ACTIONS
By consenting to the terms of this Agreement, the User agrees that he/she will not utilize or engage in any unsolicited bulk mail, email or messaging programs (”Spam”) for the purpose of attracting new referrals. In the event of a substantiated Spam complaint, the User will forfeit eligibility in the ReferralProgram and lose all earned remuneration held in the User’s account.
YourMotorBikePhoto bears no responsibility for any actions the User performs with banners, logos, links and other elements of design and intellectual property of the Site.
As a member of Referral Program, the User confirms and guarantees that under no circumstances will he/she pose as an employee, manager, consultant or contractor of YourMotorBikePhoto or perform any actions that could be interpreted as being carried out by employees, management, consultants or contractors of YourMotorBikePhoto.
The User agrees and understands that his/her consent to this Agreement and participation in the Referral Program is in no way an indication of an employer/employee relationship, partnership or other business agreement/arrangement between the User and YourMotorBikePhoto aside from the explicit terms indicated within this Agreement.
The User also confirms and agrees not to use YourMotorBikePhoto' brand queries in search engine and contextual advertising; any brand names owned by YourMotorBikePhoto are forbidden to use in paid search campaigns, both in keywords and in ad copy.
2.5 PROCEDURE FOR REIMBURSEMENT
The User agrees to pay and indemnify, protect and advocate for YourMotorBikePhoto (its management, employees, shareholders, partners, affiliates and so on) against any claims, responsibilities, losses and expenses (including lawyers’ fees on a client basis and solicitor), as a result of any known or unknown violation in the terms and conditions of this Agreement.
YourMotorBikePhoto reserves the right to assume control and defense of any matter or require compensation or indemnification from the User at the expense of the User. In this case the User agrees to cooperate with YourMotorBikePhoto’ defense in case of such claim.
2.6 APPLICABLE LAW
The validity, interpretation and enforcement of this Agreement, matters arising out of or related to performance or breach of this Agreement, and related matters shall be governed by the internal laws of the State of New York (without reference to choice of law doctrine). Any legal action or proceeding concerning the validity, interpretation and enforcement of this Agreement, matters arising out of or related to performance or breach of this Agreement, and related matters, shall be brought exclusively in the State or Federal courts located in the State and County of New York. All parties consent to the exclusive jurisdiction of those courts, waiving any objection to the propriety or convenience of such venues. The United Nations Convention on Contracts for the International Sale of Goods does not apply to or otherwise affect this Agreement.
The User agrees to service and process of all necessary notifications directed to him/her at the postal address indicated by him/her during registration at the Site. The User agrees to refrain from:
Any rights that he/she could have to the process or result of a trial by jury;
Taking part or organizing any collective claim against YourMotorBikePhoto in connection with the Site work, provisions of this Agreement or any agreements considered herein.
If YourMotorBikePhoto is obligated to go to non-arbitration court for collection of any payable fees or enforcement of its rights, the User agrees to reimburse YourMotorBikePhoto for all expenses, payments and fees in the event that YourMotorBikePhoto is successful.
2.7 GENERAL PROVISIONS
The User confirms that, in addition to the terms of this Agreement, he/she has familiarized himself/herself with the Terms of Use and other agreements that are referenced in this Agreement, and agrees with the restrictions which they impose.
Absence of a result of actions performed by YourMotorBikePhoto for organization or control of accurate implementation of the provisions of this or affiliated agreements shall not and can not be construed as waiver of any rights or provisions.

2.9 ACKNOWLEDGEMENT
IN ACCEPTING THIS AGREEMENT, THE USER ACKNOWLEDGES THAT THE USER HAS READ THIS AGREEMENT, UNDERSTANDS IT, AND HAD AN OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE PRIOR TO AGREEING TO IT. USER AGREES TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. USER FURTHER AGREES THAT THIS IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN USER AND YourMotorBikePhoto, WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATION BETWEEN USER AND YourMotorBikePhoto RELATING TO THE SUBJECT OF THIS AGREEMENT.
